Terms of Use
These terms govern your use of the website at hardel.in and the applications published by Hardel Private Limited, including Mise. By using the website or an app, you agree to them.
1. Acceptance
These terms are an agreement between you and Hardel Private Limited ("Hardel", "we", "us"). If you use the services for an organisation, you confirm that you have authority to bind it, and "you" includes that organisation. If you do not agree to these terms, do not use the services.
The website at hardel.in and the apps we publish are together called the services. Our Privacy Policy explains how we handle personal data and forms part of these terms.
2. The website
You may browse the website for your own information. You may not use it in a way that damages it, interferes with anyone else's use of it, or breaks any law. We may change or withdraw any part of the website without notice.
3. The apps
Accounts. Some features need an account. You must give accurate information and keep it up to date. You are responsible for keeping your login details private and for everything done through your account. Tell us at once at info@hardel.in if you think your account has been used without your permission.
Acceptable use. You agree not to:
- use the apps for anything unlawful;
- upload content that you have no right to use, or that is unlawful, harmful or infringes someone else's rights;
- try to gain unauthorised access to the apps, other accounts or our systems;
- interfere with the operation of the apps, for example by overloading them or introducing malicious code;
- copy, modify, distribute, sell or lease any part of the apps.
Your content. You own the content you create or upload. You give Hardel a licence to host, store, process, display and transmit that content only as needed to operate the services and provide them to you. The licence ends when you delete the content or your account, except for copies held in backups for a limited period. You are responsible for your content and for having the rights to use it.
No reverse engineering. You may not reverse engineer, decompile, disassemble or otherwise try to obtain the source code of the apps, except where the law expressly allows it.
Availability. We aim to keep the apps available and working, but we do not guarantee that they will be uninterrupted, error-free or always available. We may change, suspend or discontinue features at any time. Keep your own copies of anything important.
Suspension. We may suspend or close your account if you break these terms, if the law requires it, or if your use creates risk for us or for others. Where reasonable, we will tell you why.
4. Intellectual property
The Hardel name and wordmark, our product names and logos, including Mise, and the services themselves, including their design, code and content, belong to Hardel Private Limited or its licensors. Except for the rights expressly given in these terms, we keep all rights. You may not use our names, marks or logos without our written permission.
5. Third-party services
The services may link to or work with websites, platforms and services run by others, including the platforms through which you obtain the apps and your device's operating system. We do not control them and are not responsible for them. Their own terms and privacy policies apply.
6. Disclaimer of warranties
The services are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including as to merchantability, fitness for a particular purpose, accuracy or non-infringement.
Designs, measurements and augmented-reality views produced with our apps are aids to planning. They are not a substitute for professional measurement, structural or safety assessment, or compliance checks. You are responsible for verifying anything you rely on.
7. Limitation of liability
To the fullest extent permitted by law, Hardel will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising from or related to the services, even if we have been told that such damages are possible.
To the fullest extent permitted by law, our total liability for all claims relating to the services will not exceed the amount you paid us for the services in the twelve months before the claim arose.
Nothing in these terms limits any liability that cannot be limited by law.
8. Termination
You may stop using the services at any time, and you may ask us to delete your account by writing to info@hardel.in. We may end or suspend your access as described in section 3. On termination your right to use the apps ends. Sections 4, 6, 7 and 9, and any other terms that by their nature should continue, survive termination.
9. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to any law that provides otherwise, disputes relating to these terms or the services are subject to the exclusive jurisdiction of the courts having jurisdiction over our registered office.
10. Changes
We may update these terms from time to time. When we do, we will update the effective date on this page and, for significant changes, tell you through the services or by email. Continuing to use the services after a change means you accept the updated terms.
